denr say awaited on writ of kalikasan compromise
BAGUIO CITY – The compromise agreement for the settlement of the Writ of Kalikasan case against the city over the use of Irisan dumpsite has been submitted to the Court of Appeals but the court decision will have to wait until the position of the Dept. of Environment and Natural Resources (DENR) and the National Solid Waste Management Board (NSWMB) on said accord had been heard.
Mayor Mauricio Domogan bared this during his Ugnayang Panlungsod press briefing on Wednesday.
The mayor said the settlement has been signed by both parties with city officials as signatories for the city government.
According to the city legal office under lawyer Melchor Carlos Rabanes, a “joint motion for the rendition of consent decree” signed by both parties was submitted to the CA last week. A consent decree is said to be equivalent to “judgement based on compromise” in a regular case.
The motion is up for resolution by the court pending submission of a manifestation from the DENR’s Environmental Management Bureau (EMB) and the NSWMB as represented in the case by the Office of the Solicitor General (OSG).
The DENR and NSWMB manifestation may or may not be in support of the settlement and may contain the agency’s comments on the points of settlement raised by both parties in the accord.
Domogan said the settlement is geared toward the total closure of the dumpsite and its conversion into an eco-park.
He said the city has been moving towards the said direction but its efforts were thwarted by the trash slide that occurred in the area last year.
He said that in anticipation of the settlement, the city is now fast-tracking the implementation of the restoration work for the collapsed retaining wall to be funded by the P80 million approved by Malacanang recently through the Dept. of Public Works and Highways (DPWH).
He said the city is currently completing the procedural and documentary requirements and will be ready to award the project to a qualified contractor once the process has been completed.
He said the city’s Bids and Awards Committee decided to employ the fastest means allowed by law to award the project so that it will be implemented and completed soon amid the start of the rainy season. – A Refuerzo
